In early 2022, the Victims of Crime (Financial Assistance Scheme) Act 2022 (Vic) (FAS Act) was passed into law, promising a new administrative scheme to deliver financial assistance to victims of crime in Victoria. Legal representation remains a crucial component for victims seeking state-funded financial assistance.
Access to legal representation is vital for victims as lawyers are better equipped than case managers to identify evidentiary or eligibility issues and help victims navigate complex processes. Experienced lawyers can also conceive unique items of recovery more suited to the applicant’s needs, unlike case managers who would be charged to follow a process designed by the scheme-decision maker.
Under the new scheme, there is an increased emphasis on a trauma-informed approach to understanding and responding to the needs of individuals who have experienced trauma. Legal practitioners are expected to prioritise the individual’s autonomy and informed consent, be aware of the potential triggers for re-traumatisation, and avoid practices that may further traumatise the individual.
